المناسب والغريب والتعليل به عند الأصوليين

الملخص

يتناول هذا البحث قضية في غاية الأهمية ترتبط بعلم هو من أدق العلوم الشرعية وأحكمها وهو علم أصول الفقه، وهي قضية تتكلم عن التعليل بالمناسب الغريب عند الأصوليين.

فالمناسب الغريب لم ينل حظه من البحث والدراسة في مبحث التعليل؛ ولذلك تحاول هذه الدراسة الوقوف على حقيقته، ودراسته دراسة علمية قويمة، وكل ذلك من خلال استحضار أقوال أهل العلم، وتحرير إشكالاتهم في ذلك؛ سواء تعلق الأمر بحجيته أو تفريعاته أو أمثلته وشواهده التي ذكرت له في الكتب الأصولية والمقاصدية.

وقد خلص البحث إلى نتائج مهمة من بينها أن الأصوليين قد تحدثوا عن نوعين من المناسب الغريب وجب التفريق بينهما عند التعامل الكتب الأصولية؛ الأول: معتبر وهو محل اجتهاد ونظر عند الأصوليين، وثان: ملغى بإتفاق العلماء، ولا يعتد به في التعليل، كما أن الشواهد والأمثلة والتطبيقات التي ذكرت للمناسب الغريب قليلة جدا، وقد حاول البحث أن يجمع أكبر قدر لها من مظانها.

Abctract

This research deals with a very important issue related to the fundamentals of jurisprudence, this an issue talk about Reasoning by “Almunasib Algharib” for the scholars of Usul al-Fiqh.

The “Almunasib Algharib”  did not get his luck from research and study in fields of Altaelil Al’usuliu . Therefore, this study tries to find out what it is, and to study it in a proper scientific study, and all of this is through evoking the sayings of scholars and liberating their problems in that. Whether it is related to his argument, his divisions, his examples, or his examples and evidences that were mentioned to him in the books of fundamentalism and maqasid and others.

The research concluded important results, including that the fundamentalists have spoken of two types of “Almunasib Algharib”  that must be distinguished between them when reading fundamentalist books. The first: is significant and is the subject of diligence and consideration by the fundamentalists, and the second: it is canceled by the consensus of the scholars, and it is not considered in the reasoning, just as the evidence, examples and applications mentioned for the strange occasion are very few, and the research has tried to collect as much of its significance as possible, and mention its objections and clarify them to the reader.
